5M-16. Best Management Practices For Florida Citrus |
1(1) In order to retain a presumption of compliance with state water quality standards:
15(a) Citrus growers who, prior to the effective date of this rule, submitted a Notice of Intent to Implement 34Nitrogen Best Management Practices for Florida Ridge Citrus (July 23, 2002) and adopted by reference in Rule 515E-1.023, 52F.A.C., must:
541. Within two years of the effective date of this rule, submit a new NOI and BMP checklist in accordance with Rule 765M-16.003, 77F.A.C., and,
792. Implement the applicable BMPs on the checklist, in accordance with Rule 915M-16.003, 92F.A.C.
93(b) Flatwoods citrus growers who, prior to the effective date of this rule, submitted a NOI and checklist under the programs listed in subparagraphs 1., 2., or 3., below must continue to implement the applicable BMPs on the checklist, and must follow the guidelines applicable to the operation contained in Nutrition of Florida Citrus Trees, Second Edition, UF-IFAS Publication SL253 (January 2008), hereby adopted and incorporated by reference. 2112. Best Management Practices for Citrus Groves in the Peace River and Manasota Basins (October 2004), adopted by reference in Rule 2325M-5.002, 233F.A.C.
2343. Best Management Practices for Gulf Citrus (March 2006), adopted by reference in Rule 2485M-7.002, 249F.A.C.
250(2) Flatwoods citrus growers re-establishing inactive groves or renovating groves, who enrolled prior to the effective date of this rule, must contact FDACS for assistance in submitting a new NOI and BMP checklist pursuant to Rule 2865M-16.003, 287F.A.C.
288(3) NOIs or BMP checklists submitted on or after the effective date of this rule chapter for citrus BMP programs adopted prior to the effective date of this rule chapter will be deemed invalid.
