60A-1. General Regulations |
1(1) Agencies intending to purchase Commodities or Contractual Services in excess of CATEGORY TWO from a single source shall electronically post Form PUR 7776 “Description of Intended Single Source Purchase,” revised 07/2022, 34which is incorporated herein by reference and available 42at 43http://www.flrules.org/Gateway/reference.asp?No=Ref-14517, 45or on the Department’s website at 51http://dms.myflorida.com/purforms. Form PUR 7776 requests that prospective vendors provide information regarding their ability to supply the Commodities or Contractual Services described.
72(2) Agencies shall provide notice of their determination that the Commodities or Contractual Services are available only from a single source by electronically posting Form PUR 7778 “Notice of Intended Decision to Enter Into a Single Source Contract,” revised 07/2022, which is incorporated herein by reference and available 121at 122http://www.flrules.org/Gateway/reference.asp?No=Ref-14518, 124or on the Department’s website at 130http://dms.myflorida.com/purforms.
131(3) Agencies shall report all single source action(s) quarterly by submitting Form PUR 7779, “Single Source Action Agency Report Form,” effective 07/2022, which is hereby incorporated by reference and available at 163http://www.flrules.org/Gateway/reference.asp?No=Ref-14519 165or on the Department’s website at http:dms.myflorida.com/purforms. All single source actions must be reported to the Department no later than ten (10) calendar days after the end of the quarter in which the action was completed, with the first quarter beginning on July 1 of each fiscal year.
213(4) 214For 215emergency 216purchases 217of Commodities or 220Contractual 221Services, Agencies must complete and furnish to the Department, Form PUR 7800 “Notice of Emergency Purchase,” revised 07/2022, which is hereby incorporated by reference 246and available 248at 249http://www.flrules.org/Gateway/reference.asp?No=Ref-14520, 251or on the Department’s website at 257http://dms.myflorida.com/purforms.
258(5) Emergency 260purchases 261need not be posted electronically or by any other means.
271(6) An Agency must request approval from the Department to purchase Commodities or Contractual Services from contracts competitively established by another Agency, or let by the federal government, another state or a political subdivision, by submitting Form PUR 7102, “Agency Request for Approval of Alternate Contract Source 318(ACS),” 320revised 07/2022, 322which is hereby incorporated by reference and available at 331http://www.flrules.org/Gateway/reference.asp?No=Ref-14516, 333or 334on the Department’s website at 339http://dms.myflorida.com/purforms. 340The ACS contract must contain specific language authorizing third parties to make purchases from the contract with the vendor’s consent.
360(7) In addition, a list of current ACS contracts for use by all Agencies is available at http://dms.myflorida.com/contracts.
