61G5-30. Disciplinary Guidelines |
1(1) Definitions. As used in this rule;
8(a) “Citation” means an instrument which meets the requirements set forth in Section 21455.224, F.S., 23and which is served upon a subject for the purpose of assessing a penalty in an amount established by this rule;
44(b) “Subject” means the licensee, applicant, person, partnership, corporation, or other entity alleged to have committed a violation designated in this rule.
66(2) In lieu of the disciplinary procedures contained in Section 76455.225, F.S., 78the Department is hereby authorized to dispose of any violation designated herein by issuing a citation to the subject within six months after the filing of the complaint which is the basis for the citation.
113(3) Citations shall be issued for the first offense violations only.
124(4) The Board hereby designates the following as citation violations, which shall result in a penalty of fifty dollars ($50.00):
144(a) Except as otherwise provided herein, any violation of the safety, sanitary, or other salon requirements specified in Rule 16361G5-20.002, 164F.A.C. – however, if it is an initial offense and there are no other violations, then the subject shall be given a Notice of Noncompliance;
189(b) Practicing cosmetology or a specialty with an inactive or expired license for one month or part of a month;
209(c) Operating a salon with a delinquent license for one month or part of a month;
225(d) Employing a person to practice cosmetology or a specialty with an inactive or expired license for one month or part of a month.
249(e) Unless otherwise permitted in Chapter 477, F.S., performing cosmetology services in a salon which does not have a license in violation of Section 273477.0263(1), F.S.
275(5) The Board hereby designates the following as citation violations, which shall result in a penalty of one hundred dollars ($100.00):
296(a) Transferring ownership or changing location of a salon without the approval of the Department pursuant to Rule 31461G5-20.006, 315F.A.C., provided the transfer of ownership or change of location has not exceeded 90 days and the salon owner can provide proof that a completed application has been filed with the Department;
347(b) Practicing cosmetology or a specialty with an inactive or expired license for more than one month but not more than two months;
370(c) Operating a salon with a delinquent license for more than one month but not more than two months;
389(d) Employing a person to practice cosmetology or a specialty with an inactive or expired license for more than one month but not more than two months;
416(e) Two violations of the safety, sanitary, or other salon requirements specified in Rule 43061G5-20.002, 431F.A.C.
432(6) The Board hereby designates the following as citation violations, which shall result in a penalty of one hundred and fifty dollars ($150.00):
455(a) Practicing cosmetology or a specialty with an inactive or expired license for more than two months but not more than three months;
478(b) Operating a salon with a delinquent license for more than two months but not more than three months;
497(c) Employing a person to practice cosmetology or a specialty with an inactive or expired license for more than two months but not more than three months.
524(7) The Board hereby designates the following as citation violations, which shall result in a penalty of two hundred dollars ($200.00):
545(a) Practicing cosmetology or a specialty with an inactive or expired license for more than three months but not more than four months;
568(b) Operating a salon with a delinquent license for more than three months but not more than four months;
587(c) Employing a person to practice cosmetology or a specialty with an inactive or expired license for more than three months but not more than four months;
614(8) The Board hereby designates the following as citation violations, which shall result in a penalty of two hundred and fifty dollars ($250.00):
637(a) Operating a salon without disinfecting solutions as required by paragraph 64861G5-20.002(3)(d), 649F.A.C.;
650(b) Three violations of the safety, sanitary, or other salon requirements specified in Rule 66461G5-20.002, 665F.A.C.;
666(c) Practicing cosmetology or a specialty with an inactive or expired license for more than four months but not more than five months;
689(d) Operating a salon with a delinquent license for more than four months but not more than five months; and
709(e) Employing a person to practice cosmetology or a specialty with an inactive or expired license for more than four months but not more than five months.
736(9) The Board hereby designates the following as citation violations, which shall result in a penalty of three hundred dollars ($300.00):
757(a) Practicing cosmetology or a specialty with an inactive or expired license for more than five months but not more than six months;
780(b) Operating a salon with a delinquent license for more than five months but not more than six months;
799(c) Employing a person to practice cosmetology or a specialty with an inactive or expired license for more than five months but not more than six months; and
827(d) Four violations of the safety, sanitary, or other salon requirements specified in Rule 84161G5-20.002, 842F.A.C.
843(10) The Board hereby designates the following as citation violations, which shall result in a penalty of three hundred and fifty dollars ($350.00):
866(a) Practicing cosmetology or a specialty with an inactive or expired license for more than six months but not more than seven months;
889(b) Operating a salon with a delinquent license for more than six months but not more than seven months; and
909(c) Employing a person to practice cosmetology or a specialty with an inactive or expired license for more than six months but not more than seven months.
936(11) The Board hereby designates the following as citation violations, which shall result in a penalty of four hundred dollars ($400.00):
957(a) Practicing cosmetology or a specialty with an inactive or expired license for more than seven months but not more than eight months;
980(b) Operating a salon with a delinquent license for more than seven months but not more than eight months; and
1000(c) Employing a person to practice cosmetology or a specialty with an inactive or expired license for more than seven months but not more than eight months.
1027(12) The Board hereby designates the following as citation violations, which shall result in a penalty of four hundred and fifty dollars ($450.00):
1050(a) Practicing cosmetology or a specialty with an inactive or expired license for more than eight months but not more than nine months;
1073(b) Operating a salon with a delinquent license for more than eight months but not more than nine months; and
1093(c) Employing a person to practice cosmetology or a specialty with an inactive or expired license for more than eight months but not more than nine months.
1120(13) The Board hereby designates the following as citation violations, which shall result in a penalty of five hundred dollars ($500.00):
1141(a) Practicing cosmetology or a specialty without a license;
1150(b) Operating a salon without a license;
1157(c) Employing a person to practice cosmetology or a specialty without a license;
1170(d) Practicing cosmetology or a specialty with an inactive or expired license for more than nine months but not more than twelve months;
1193(e) Operating a salon with a delinquent license for more than nine months but not more than twelve months; and
1213(f) Employing a person to practice cosmetology or a specialty with an inactive or expired license for more than nine months but not more than twelve months.
