61G7-7. Discipline |
1In accordance with Section 5120.695, F.S., 7the Department shall issue a notice of noncompliance as a first enforcement action against a licensee for a minor violation of a rule. Pursuant to Sections 33120.695 34and 35455.225(3), F.S., 37the Board designates the following minor violations for issuance of a notice of noncompliance for an initial offense:
55(1) Failure to notify the Board within 30 days of change of address, in violation of paragraph 7261G7-10.002(2)(i), 73and subsection (3), F.A.C., and paragraph 79468.532(1)(j), F.S.
81(2) Failure to post license in conspicuous place, in violation of subsection 93468.530(2), F.S.
95(3) Engagement in the business under any name other than that specified on the license, in violation of subsection 114468.530(3), F.S.
116(4) Failure to include the employee leasing company license number in advertisements as required by subsection 13261G7-11.001(3), 133F.A.C., and in violation of subsection 139468.530(4), F.S.
141(5) Failure of the employee leasing company or the controlling person to notify the Board within a 90-day period that a controlling person has ceased performing controlling person duties, as long as at least one controlling person remains licensed at the employee leasing company, as required by paragraphs 18961G7-10.002(2)(g), 190(h), and subsection (3), F.A.C.
195(6) Failure of the employee leasing company to file a quarterly report as required by subsection 21161G7-10.001(1), 212F.A.C., and authorized by Section 217468.535, F.S., 219within 30 days of receiving notice from the Board that the quarterly report is late.
234(7) Failure of the employee leasing company to file an annual report as required by subsection 25061G7-10.0011(1), 251F.A.C., and paragraph 254468.525(3)(e), F.S., 256within 30 days of receiving notice from the Board that the annual report is late.
271(8) Failure of the employee leasing company to submit and pay an annual assessment as required by subsection 28961G7-5.002(1), 290F.A.C.
