61G10-14.004. Minor Violations  


Effective on Thursday, November 8, 1990
  • 1(1) Subject to the limitations imposed by this rule, the following violations are designated as minor for the purposes of Section 22455.225(3), 23Florida Statutes.

    25(a) Violation of Section 29481.325(1)(i) 30by practicing on an inactive license provided such license is reactivated within two months of its expiration.

    47(b) Violation of Rule 5161G10-15.003, 52Florida Administrative Code, so long as there is no allegation of consumer injury as a result of the violation and the advertisement which is in violation is capable of being withdrawn from circulation to the public within 15 days of issuance of the notice of nomcompliance.

    98(c) Violation of Rule 10261G10-11.010(1)-103(2), (5) providing that any violation is rectified within 15 days of the issuance of the notice of noncompliance.

    122(2) The designation of violations as minor for the purposes of Section 455.255(3), Florida Statutes, is limited to initial violations.

    142(3) A monthly report of notices of noncompliance issued by the Department shall be reviewed by the Board to monitor the use and success of this procedure.

    169(4) Notices of noncompliance issued shall be reviewed by the Probable Cause Panel in any consideration of subsequent allegations of similar violations by the licensee.
