62-107.030. Expenditure of Funds from the Water Quality Assurance Trust Fund

  • 1(1) In responding to short-term emergencies, the Department may use monies from the Water Quality Assurance Trust Fund for, among other things, the following purposes:

    26(a) Contracting with independent contractors for the assessment and taking of remedial action to alleviate a short-term emergency.

    44(b) For the purchase or rental of equipment needed to relieve a short-term emergency.

    58(c) For the temporary repair of structures or facilities as necessary to relieve a short-term emergency.

    74(d) To provide a temporary alternate source of drinking water where a community water system (as defined in Rule 62-22.103, F.A.C.,) or a private well that provides water to residential dwellings has been contaminated to such an extent as to result in a short-term emergency.

    120(2) Generally, trust fund monies shall not be used for the following purposes:

    133(a) Routine maintenance and normal repair of structures or facilities.

    143(b) Permanent or long-term replacement of structures or facilities, unless such repair or replacement is the only feasible means of preventing or abating a short-term emergency.

    169(c) Administrative costs of other governmental agencies involved in cleanup operations.
