3745(a) General Applicability and Definitions.
37501. 3751The purpose and effect of each subpart of 375940 C.F.R Part 60 3763or portion thereof adopted and incorporated by reference in this subsection is determined by the context in which it is cited within this subsection. 3787The Emission Guidelines for Existing Sources adopted by reference in this rule shall be controlling over other standards in the air pollution rules of the Department except that any emissions limiting standard contained in or determined pursuant to the air pollution rules of the Department which is more stringent than one contained in an Emission Guideline, or which regulates emissions of pollutants or emissions units not regulated by an applicable Emission Guideline, shall apply.
38612. For the purposes of subsection 386762-204.800(9), 3868F.A.C., the definitions contained in the various provisions of 387740 C.F.R. Part 60 3881adopted herein shall apply, except that the term “Administrator,” when used in any provision of 389740 C.F.R. Part 60 3901that is delegated to the Department by the U.S. Environmental Protection Agency, shall mean the Secretary or the Secretary’s designee.
3921(b) Municipal Waste Combustors. 392540 C.F.R. 60, 3928Subpart Cb, Emission Guidelines and Compliance Times for Large Municipal Waste Combustors That Are Constructed on or Before September 20, 1994, revised as of July 1, 2009, is hereby adopted and incorporated by reference, subject to the following provisions:
39671. Applicability. The applicability of paragraph 397362-204.800(9)(b), 3974F.A.C., shall be the same as set forth in 398340 C.F.R. §60.32b.
39862. Definitions. For purposes of paragraph 399262-204.800(9)(b), 3993F.A.C., the definitions in 399740 C.F.R. §60.31b 4000shall apply.
40023. Emission Limiting Standards.
4006a. The emission limit for particulate matter shall be the same as set forth in 402140 C.F.R. §60.33b(a)(1)(i).
4024b. The opacity limit shall be the same as set forth in 403640 C.F.R. §60.33b(a)(1)(iii).
4039c. The emission limits for cadmium and lead shall be the same as set forth in 405540 C.F.R. §60.33b(a)(2)(i) 4058and (a)(4).
4060d. The emission limit for mercury shall be the same as set forth in 407440 C.F.R. §60.33b(a)(3) 4077except that, where applicable, the emission limiting standards of rule 408762-296.416, 4088F.A.C., also shall apply.
4092e. The emission limit for sulfur dioxide shall be the same as set forth in 410740 C.F.R. §60.33b(b)(1)(i) 4110and (b)(3)(i).
4112f. The emission limit for hydrogen chloride shall be the same as set forth in 412740 C.F.R. §60.33b(b)(2)(i) 4130and (b)(3)(ii).
4132g. The emission limit for total mass dioxin/furans (tetra- through octa-chlorinated dibenzo-p-dioxins and dibenzofurans) shall be the same as set forth in 415440 C.F.R. §60.33b(c)(1)(i), 4157(c)(1)(ii), and (c)(1)(iii).
4160h. The emission limit for nitrogen oxides shall be the same as set forth in 417540 C.F.R. 60 4178Subpart Cb, Table 1, or 418340 C.F.R. §60.33b(d)(3) 4186as applicable. Emissions averaging pursuant to 419240 C.F.R. §60.33b(d)(1) 4195shall be allowed. 419840 C.F.R. §60.33b(d)(2) 4201shall not apply.
4204i. The emission limit for carbon monoxide shall be the same as set forth in 421940 C.F.R. 60, 4222Subpart Cb, Table 3.
42264. Operating Practices. The operating practices applicable to each municipal waste combustor unit subject to paragraph 424262-204.800(9)(b), 4243F.A.C., shall be the same as set forth in 425240 C.F.R. §60.53b(b) 4255and (c).
42575. Operator Training. The operator training and certification requirements of 426740 C.F.R. §60.54b 4270shall apply to all municipal waste combustor units subject to paragraph 428162-204.800(9)(b), 4282F.A.C. Compliance with these requirements shall be conducted according to the schedule specified in 429640 C.F.R. §60.39b(c)(4).
42996. Fugitive Ash Emissions. The fugitive ash emissions requirements applicable to each municipal waste combustor unit subject to paragraph 431862-204.800(9)(b), 4319F.A.C., shall be the same as set forth in 432840 C.F.R. §60.55b.
43317. Compliance and Performance Testing.
4336a. The compliance and performance testing requirements applicable to each municipal waste combustor unit subject to paragraph 435362-204.800(9)(b), 4354F.A.C., shall be the same as set forth in 436340 C.F.R. §60.58b, 4366except as provided for under 437140 C.F.R. §60.24(b)(2) 4374and subparagraph 437662-204.800(9)(b)7.b., 4377F.A.C.
4378b. The alternative performance testing schedule for dioxins/furans specified in 438840 C.F.R. §60.58b(g)(5)(iii) 4391shall apply to municipal waste combustor plants that achieve a dioxin/furan emission level less than or equal to 15 nanograms per dry standard cubic meter, corrected to 7 percent oxygen.
44218. Reporting and Recordkeeping. The reporting and recordkeeping requirements applicable to each municipal waste combustor unit subject to paragraph 444062-204.800(9)(b), 4441F.A.C., shall be the same as set forth in 445040 C.F.R. §60.59b, 4453except for the siting requirements under 445940 C.F.R. §60.59b(a), 4462(b)(5) and (d)(11).
4465(c) Municipal Solid Waste Landfills. 447040 C.F.R. 60, 4473Subpart Cc, Emission Guidelines and Compliance Times for Municipal Solid Waste Landfills, revised as of July 1, 2009, is hereby adopted and incorporated by reference, subject to the following provisions:
45031. Applicability.
4505a. The facility to which paragraph 451162-204.800(9)(c), 4512F.A.C., applies is each existing municipal solid waste (MSW) landfill:
4522(I) For which construction, reconstruction or modification was commenced before May 30, 1991; and,
4536(II) Which has accepted waste at any time since November 8, 1987, or has additional design capacity available for future waste deposition.
4558b. Physical or operational changes made to an existing MSW landfill solely to comply with the provisions of paragraph 457762-204.800(9)(c), 4578F.A.C., are not considered a modification or reconstruction and would not subject an existing MSW landfill to the requirements of 459840 C.F.R. 60, 4601Subpart WWW (see 460440 C.F.R. §60.7504607).
46082. Definitions. The terms used but not defined in 461740 C.F.R. 60, 4620Subpart Cc, have the meaning given to them in the Act and in Subparts A, B, and WWW of 463940 C.F.R. §60.
46423. Standards for Air Emissions from MSW Landfills.
4650a. Each owner or operator of an MSW landfill subject to paragraph 466262-204.800(9)(c), 4663F.A.C., and which also meets the following conditions as of December 31, 1996, shall comply with the provisions of 468240 C.F.R. §60.752(b)(2)(i) 4685through (v) commencing from December 31, 1996.
4692(I) The landfill has a design capacity greater than or equal to 2.5 million Megagrams and 2.5 million cubic meters. The landfill may calculate design capacity in either Megagrams or cubic meters for comparison with the exemption values. Any density conversions shall be documented and submitted with the initial design capacity report and any application for a solid waste permit; and,
4753(II) The landfill has a nonmethane organic compound (NMOC) emission rate of 50 Megagrams per year or more.
4771b. Any MSW landfill which has a design capacity greater than or equal to 2.5 million Megagrams and 2.5 million cubic meters but whose NMOC emission rate as of December 31, 1996, is less than 50 Megagrams per year shall comply with the provisions of 481640 C.F.R. §60.752(b)(2)(i) 4819through (v) commencing from December 31 of the first year after 1996 for which the nonmethane organic compound emission rate equals or exceeds 50 Megagrams per year.
48464. Compliance Procedures. Each owner or operator of an MSW landfill subject to the air emissions standards of subparagraph 486562-204.800(9)(c)3., 4866F.A.C., shall:
4868a. Comply with the operational standards in 487540 C.F.R. §60.753;
4878b. Comply with the compliance provisions in 488540 C.F.R. §60.755; 4888and,
4889c. Comply with the monitoring provisions in 489640 C.F.R. §60.756.
48995. Reporting and Recordkeeping. Each owner or operator of an MSW landfill to which paragraph 491462-204.800(9)(c), 4915F.A.C., applies shall comply with the reporting and recordkeeping provisions of 492640 C.F.R. §60.757 4929and.758, as applicable, except that the initial design capacity report and NMOC emission rate report described in 494640 C.F.R. §60.757 4949shall be submitted to the Department no later than December 31, 1996. The provisions of 496440 C.F.R. §60.754, 4967as applicable, shall be used to calculate the landfill NMOC emission rate for the purposes of the submittal of NMOC emission rate reports and determining whether the landfill has a nonmethane organic compound (NMOC) emission rate of 50 Megagrams per year or more.
50106. Permit Application Deadline. Each existing MSW landfill that is subject to paragraph 502362-204.800(9)(c), 5024F.A.C., and has a design capacity greater than or equal to 2.5 million Megagrams and 2.5 million cubic meters is subject to the permitting requirements of chapter 62-213, F.A.C. Any existing MSW landfill subject to the requirements of chapter 62-213, F.A.C., solely because it is subject to paragraph 507262-204.800(9)(c), 5073F.A.C., shall file an application for an operation permit under the requirements of chapter 62-213, F.A.C., no later than December 31, 1997.
50957. Effective Date of State Emission Standards for MSW Landfills. The provisions of paragraph 510962-204.800(9)(c), 5110F.A.C., shall become effective on December 31, 1996.

5121(e) Small Municipal Waste Combustion Units. 512740 C.F.R. Part 60, 5131Subpart BBBB, Emission Guidelines and Compliance Times for Small Municipal Waste Combustion Units Constructed on or Before August 30, 1999, revised as of July 1, 2009, is hereby adopted and incorporated by reference subject to the following provisions:

5321c. Operating Requirements. The operating requirements applicable to each small municipal waste combustion unit subject to paragraph 533862-204.800(9)(e), 5339F.A.C., shall be the same as set forth in 534840 C.F.R. Part 60, 5352Subpart BBBB.

59364. Operator Training and Qualification. The operator training and qualification requirements applicable to each CISWI unit subject to paragraph 595562-204.800(9)(f), 5956F.A.C., shall be the same as set forth in 596540 C.F.R. 5967§§60.2635 through 60.26655970.
59715. Emission Limitations and Operating Limits. The emission limitations and operating limits applicable to each CISWI unit subject to paragraph 599162-204.800(9)(f), 5992F.A.C., shall be the same as set forth in 600140 C.F.R. 6003§§60.2670 through 60.2680, 6006except that a unit in the waste-burning kiln subcategory may instead comply with one or more of the following production-based emission limits:

60836. Performance Testing. The performance testing requirements applicable to each CISWI unit subject to paragraph 609862-204.800(9)(f), 6099F.A.C., shall be the same as set forth in 610840 C.F.R. 6110§§60.2690 and 60.2695, except that a unit in the waste-burning kiln subcategory complying with the production-based particulate matter emission limit in sub-subparagraph 613262-204.800(9)(f)5.b., 6133F.A.C., shall demonstrate compliance annually pursuant to 614040 C.F.R. 63.1349(b)(1)6143.
61447. Initial Compliance Requirements. The initial compliance requirements applicable to each CISWI unit subject to paragraph 616062-204.800(9)(f), 6161F.A.C., shall be the same as set forth in 617040 C.F.R. 6172§§60.2700 through 60.2706, except 6176that:
6177a. A waste-burning kiln complying with the production-based mercury emission limit in sub-subparagraph 619062-204.800(9)(f)5.a., 6191F.A.C., must demonstrate initial compliance pursuant to 619840 C.F.R. §63.1348(a)(5). 6201The initial compliance test must begin on the first operating day following completion of the field testing and data collection that demonstrates that the continuous emissions monitoring system has satisfied the relevant performance acceptance criteria 6236of 6237Performance 6238Specifications 623912A 6240or 624112B 6242in 624340 6244C.F.R. 6245Part 624660 6247Appendix 6248B.
6249b. A waste-burning kiln complying with the production-based particulate matter emission limit in sub-subparagraph 626362-204.800(9)(f)5.b., 6264F.A.C., must demonstrate initial compliance pursuant to 627140 C.F.R. §63.1348(a)(1). 6274The waste burning kilns shall demonstrate initial compliance with the production-based particulate matter limit within 180 days of providing the notification required by sub-subparagraph 629862-204.800(9)(f)7.c., 6299F.A.C.
6300c. 6301The 6302notification 6303required 6304by 630540 6306C.F.R. §60.2760 shall also include notification of whether an owner or operator of a unit in the waste-burning kiln subcategory intends to comply with one or more of the production-based emission limits in sub-subparagraphs 634062-204.800(9)(f)5.a. 6341and b., F.A.C.
63448. Continuous Compliance Requirements. The continuous compliance requirements applicable to each CISWI unit subject to paragraph 636062-204.800(9)(f), 6361F.A.C., shall be the same as set forth in 637040 C.F.R. 6372§§60.2710 through 60.2725, 6375except 6376that:

6524a. 6525For mercury, the owner or operator shall monitor emissions pursuant to 653640 C.F.R. § 63.1350(k).
6540b. For particulate matter, the owner or operator shall monitor emissions pursuant to 655340 C.F.R. § 63.1350(b).
6557c. 6558An 6559owner 6560of 6561a 6562waste 6563burning kiln is not required to develop an emissions monitoring plan pursuant to 657640 C.F.R. §63.1350(p)(1) 6579through (p)(4), if the owner prepares the emissions monitoring plan required pursuant to 659240 C.F.R. §60.2710(k) 6595and (l).
659710. Recordkeeping and Reporting Requirements. The recordkeeping and reporting requirements applicable to each CISWI unit subject to paragraph 661562-204.800(9)(f), 6616F.A.C., shall be the same as set forth in 662540 C.F.R. 6627§§60.2740 through 60.28006630. 6631Units 6632in 6633the 6634waste-burning 6635kiln 6636subcategory 6637complying 6638with one or more of the 6644production-based emission limits in sub-subparagraphs 664962-204.800(9)(f)5.a. 6650and b., F.A.C., must also keep records of all data collected from the continuous flow rate monitoring system required by 667040 C.F.R. §63.1350(n), 6673all data collected from the clinker production monitoring system required by 668440 C.F.R. §63.1350(d), 6687and all calculated 30-operating day rolling average values derived from the mercury and particulate matter monitoring system. Units in the waste-burning kiln subcategory complying with one or more of the production-based emission limits in sub-subparagraph 672262-204.800(9)(f)5.a. 6723and b., F.A.C., must also report all deviations from the production-based limits in accordance with 673840 C.F.R. §§60.2740 6741through 60.2800.
674311. Title V Operating Permits. The Title V operating permit requirements applicable to each CISWI unit subject to paragraph 676262-204.800(9)(f), 6763F.A.C., shall be the same as set forth in 677240 C.F.R. 6774§60.28056775.
677612. Air Curtain Incinerators. Requirements applicable to each Air Curtain Incinerator subject to paragraph 679062-204.800(9)(f), 6791F.A.C., shall be the same as set forth in 680040 C.F.R. 6802§§60.2810 through 60.28706805.
680613. 72176. Inspection. Each hospital/medical/infectious waste incinerator subject to paragraph 722662-204.800(9)(g), 7227F.A.C., shall comply with the inspection requirements as set forth at 723840 C.F.R. §60.36e.
72417. Compliance, Performance Testing, and Monitoring Provisions.
7248a. The compliance and performance testing requirements applicable to each hospital/medical/infectious waste incinerator subject to paragraph 726462-204.800(9)(g), 7265F.A.C., shall be the same as set forth 7273at 727440 C.F.R. 7276§727760.56c, excluding 7279the annual fugitive emissions testing requirements under §60.56c(c)(3), the CO CEMS requirements under §60.56c(c)(4), and the compliance requirements for monitoring listed in §§60.56c(c)(5)(ii) through (v), (c)(6), (c)(7), (e)(6) through (10), (f)(7) through (10), and (g)(6) through (10). Hospital/medical/infectious waste incinerators subject to the emission limits under §60.33e(a)(2) and (a)(3) may, however, elect to use CO CEMS as specified under §60.56c(c)(4) or bag leak detection systems as specified under §60.57c(h).
7348b. The monitoring requirements applicable to each hospital/medical/infectious waste incinerator subject to paragraph 736162-204.800(9)(g), 7362F.A.C., shall be the same as set forth at 737140 C.F.R. §60.57c.
7374c. The use of previous emissions test results applicable to each hospital/medical/infectious waste incinerator subject to paragraph 739162-204.800(9)(g), 7392F.A.C., shall be the same as set forth at 740140 CFR §60.37e(f).
7404d. On or after June 1, 2012, any time the owner or operator of any hospital/medical/infectious waste incinerator subject to paragraph 742562-204.800(9)(g), 7426F.A.C., conducts a performance test for any reason for particulate matter (PM), the owner or operator shall also conduct a performance test for mercury (Hg), cadmium (Cd), and lead (Pb). Testing shall be conducted in accordance with the applicable test procedures and methods set forth at 747240 C.F.R. §60.56c(b), 7475and test data shall be reported to the Department in accordance with the provisions of 749040 C.F.R. §60.58c(c). 7493This requirement for supplemental metals testing shall not apply if the owner or operator continuously monitors or samples Hg emissions in accordance with the provisions of 751940 C.F.R. §60.56c(c)(5) 7522or 752340 C.F.R §60.56c(c)(7).
75268. Reporting and Recordkeeping.
7530a. The reporting and recordkeeping requirements applicable to each hospital/medical/infectious waste incinerator subject to paragraph 754562-204.800(9)(g), 7546F.A.C., shall be the same as set forth at 755540 C.F.R. §§60.58c(b) 7558through (g), excluding §§60.58c(b)(2)(xviii) (bag leak detection system alarms), (b)(2)(xix) (CO CEMS data), and (b)(7) (siting documentation).
7575b. In addition, each hospital/medical/infectious waste incinerator subject to paragraph 758562-204.800(9)(g), 7586F.A.C., shall comply with the reporting and recordkeeping requirements of 759640 C.F.R.§60.38e(b).
75989. Compliance Times.
7601a. Each hospital/medical infectious waste incinerator subject to paragraph 761062-204.800(9)(g), 7611F.A.C., shall comply with the operator training and qualification requirements of subparagraph 762362-204.800(9)(g)4., 7624F.A.C., by June 1, 2012.
7629b. Each hospital/medical/infectious waste incinerator subject to paragraph 763762-204.800(9)(g), 7638F.A.C., shall comply with the inspection requirements of subparagraph 764762-204.800(9)(g)6., 7648F.A.C., by June 1, 2012.
7653c. Except as provided for under sub-subparagraph 766062-204.800(9)(g)9.d., 7661F.A.C., each hospital/medical/infectious waste incinerator subject to paragraph 766962-204.800(9)(g), 7670F.A.C., shall comply with all remaining requirements of paragraph 767962-204.800(9)(g), 7680F.A.C., by June 1, 2012.
7685d. Any hospital/medical/infectious waste incinerator subject to paragraph 769362-204.800(9)(g), 7694F.A.C., that chooses to comply with the alternate schedule set forth at 770640 C.F.R. §60.39e(c), 7709shall submit to the Department the information specified at 771840 C.F.R. §60.39e(d)(1)(i) 7721and (ii) as part of the permit application required pursuant to subparagraph 773362-204.800(9)(g)10., 7734F.A.C. The alternate schedule must provide for compliance with the remaining requirements of sub-subparagraph 774862-204.800(9)(g)9.d., 7749F.A.C., no later than June 1, 2014.
775610. Permit Application Deadline. Any hospital/medical/infectious waste incinerator subject to paragraph 776762-204.800(9)(g), 7768F.A.C., shall file an application for Title V permit revision no later than June 1, 2011.
778411. Related Provisions. Each hospital/medical/infectious waste incinerator subject to paragraph 779462-204.800(9)(g), 7795F.A.C., shall also comply with all requirements of paragraph 780462-296.401(4), 7805F.A.C., to the extent that such requirements are stricter than, or supplemental to, the requirements of paragraph 782262-204.800(9)(g), 7823F.A.C.
7824(h) Municipal Solid Waste Landfills. 782940 C.F.R.
