1Notwithstanding any of the prohibitions contained in this Part, the Department may issue permits for dredging and filling required for the maintenance, construction, or reconstruction of the Overseas Highway (U.S. 1) where the applicant has demonstrated that the proposed project is necessary for the protection of the public health, safety, or welfare and complies with all other Department rules.
