62-330. Environmental Resource Permitting |
1(1) An individual permit is required for activities that require a permit if they:
15(a) Do not qualify for a general permit in rules 2562-330.410 26through 2762-330.635, 28F.A.C.; and
30(b) Are not proposed for conceptual approval under rule 3962-330.055 40or 4162-330.056, 42F.A.C.
43(2) Except as otherwise provided in subsection (4), below, an application for an individual permit shall be:
60(a) Prepared using the form and procedures in rule 6962-330.060, 70F.A.C.;
71(b) Submitted in accordance with sections 4.2.3, 4.3, and 4.4 of Volume 1; and
85(c) Reviewed and acted on in accordance with rules 9462-330.062, 9562-330.071, 9662-330.075, 9762-330.090, 9862-330.301, 99and 10062-330.302, 101F.A.C., and the Applicants Handbook.
106(3) An application for a mitigation bank permit shall be processed as a type of individual permit, but also is subject to the requirements in chapter 62-342, F.A.C. If there is a conflict between this chapter and chapter 62-342, F.A.C., chapter 62-342, F.A.C., will control.
151(4) An individual permit required solely pursuant to both paragraph 16162-330.020(2)(i), 162F.A.C., and chapter 40C-44, F.A.C., shall be reviewed and acted upon in accordance with chapter 40C-44, F.A.C., (October 1, 2013), incorporated by reference herein (187https://www.flrules.org/Gateway/reference.asp?No=Ref-02533189), and application for such permit shall be made in accordance with that chapter. A copy of chapter 40C-44, F.A.C., may be obtained as provided in subsection 21662-330.010(5), 217F.A.C.
