62-4.241. Whole Effluent Toxicity Limits

  • 1(1) Facilities subject to whole effluent toxicity testing 9as identified in subsection 62-14620.620(3), F.A.C., shall meet the following whole effluent toxicity limitations unless a 26mixing zone as specified in paragraphs 3262-4.244(3)(a) 33through (d), F.A.C., or a variance has been approved by the Department.

    45(a) For acute whole effluent toxicity, the LC50, as defined in subsection 5762-302.200(1), 58F.A.C., shall not be less than 100% effluent; and

    67(b) For chronic whole effluent toxicity, the IC25, as defined in subsection 7962-302.200(14), 80F.A.C., shall not be less than 100% effluent.

    88(2) Facilities granted a chronic toxicity mixing zone i97n accordance with paragraph 62-1024.244(3)(a), F.A.C., shall meet the following whole effluent toxicity limitations.

    112(a) For acute whole effluent toxicity, the LC50, as defined in subsection 12462-302.200(1), 125F.A.C., shall not be less than 100% effluent; and

    134(b) For chronic whole effluent toxicity, the IC25, as defined in subsection 14662-302.200(14), 147F.A.C., shall not be less than the effluent concentration allowed by the mixing zone.

    161(3) Facilities with high rate dilution permitted under paragraph 17062-4.244(3)(b), 171F.A.C., 172shall meet the following whole effluent toxicity limitations.

    180(a) For acute whole effluent toxicity, the LC50, as defined in subsection 19262-302.200(1), 193F.A.C., shall not be less than 30% effluent; and

    202(b) For chronic whole effluent toxicity, the IC25, as defined in subsection 21462-302.200(14), 215F.A.C., shall not be less than 10% effluent.

    223(4) Facilities permitted as open ocean discharges under paragraph 23262-4.244(3)(c), 233F.A.C., 234shall meet the following whole effluent toxicity limitations.

    242(a) For acute whole effluent toxicity, the LC50, as defined in subsection 25462-302.200(1), 255F.A.C., shall not be less than 30% effluent; and

    264(b) For chronic whole effluent toxicity, the IC25, as defined in subsection 27662-302.200(14), 277F.A.C., shall not be less than 10% effluent.

    285(5) Water Treatment facilities granted a mixing zone for demineralization concentrate 296in accordance with paragraph 30062-4.244(3)(d), 301F.A.C., shall meet the following whole effluent 308toxicity limitations.

    310(a) For small water utility businesses, as defined in Section 320403.0882(2)(b), F.S., 322the acute whole effluent toxicity LC50, as defined in subsection 33262-302.200(1), 333F.A.C., shall not be less than 20% effluent. For demineralization concentrate discharges other than small 348water utility businesses, the LC50 shall not be less than the effluent concentration 361allowed by the mixing zone and shall not be less than 20% effluent; and

    375(b) For small water utility businesses, the chronic whole effluent toxicity IC25, as 388defined in subsection 39162-302.200(14), 392F.A.C., shall not be less than 20% effluent. For 401demineralization concentrate discharges other than small water utility businesses, the 411IC25 shall not be less than the effluent concentration allowed by the mixing zone.
