62-620. Wastewater Facility And Activities Permitting |
1(1) The following are causes for suspending, revoking, or terminating any permit issued by the Department under this chapter. The Department finds:
23(a) That the permit holder or his agent submitted false or inaccurate information in his application for a permit under this chapter or operational reports required by a permit under this chapter;
55(b) That the permit holder or his agent has violated the applicable provisions of Chapter 403, F.S., or Department rules regulating wastewater facilities or activities, or has violated Department orders or permit conditions related to the wastewater facility or activity;
95(c) That the permit holder or his agent has failed to submit operational reports or other information required by Department rules for the wastewater facility or activity;
122(d) That the permit holder or his agent has refused lawful inspection of the wastewater facility or activity under Section 142403.091, F.S., 144and subsection 14662-620.610(9), 147F.A.C.;
148(e) That the permitted wastewater facility or activity endangers human health or the environment and can only be regulated to acceptable levels by permit termination; or
174(f) That a change in any condition requires either a temporary or permanent reduction or elimination of any discharge of effluent, reclaimed water, industrial sludge or residuals use or disposal practice controlled by the permit, such as plant closure or termination of discharge by connection to another permitted facility.
223(2) No suspension, revocation, or termination shall become effective until notice is served upon the permittee in accordance with Rules 24362-110.106 244and 24528-107.004, 246F.A.C., and if requested, a hearing held within the time specified in the notice. The notice shall specify the provision of the law, the permit condition, or the Department order alleged to be violated, and the facts alleged to constitute the violation. This subsection does not preclude the Department from seeking immediate injunctive relief under Section 302403.131, F.S.
