1The owner of a phosphogypsum stack system shall prepare, by January 1, 2000, and update annually thereafter, a contingency plan to address unplanned releases of process water. The elements of such a plan shall address the applicable elements of the “National Response Team’s Integrated Contingency Plan Guidance [61 Fed. Reg. 28,641 (June 5, 1996)] which is incorporated herein by reference and shall demonstrate the ability to mobilize equipment and manpower to respond to emergency situations. The plan shall be maintained at the facility and be available for inspection by the department upon request.
