62-701. Solid Waste Management Facilities |
1(1) Performance standards. A landfill shall be designed, constructed, operated, maintained, closed, and monitored throughout its design period to control the movement of waste and waste constituents into the environment so that water quality standards and criteria and air quality standards will not be violated.
46(2) Classification of landfills. Landfills or solid waste disposal units are classified according to the types of waste received.
65(a) Class I landfills are those which receive Class I waste.
76(b) Class III landfills are those which receive only Class III waste. The Department shall exempt Class III landfills from some or all of the requirements for liners, leachate controls, and water quality monitoring in subsections 11262-701.400(3) 113and (4), and Rule 11762-701.510, 118F.A.C., if the applicant demonstrates that no significant threat to the environment will result from the exemption based upon the types of waste received, methods for controlling types of waste disposed of, and the results of the hydrogeological and geotechnical investigations required in Rule 16262-701.410, 163F.A.C. 164Such a demonstration must include a CCA treated wood management plan as described in subsection 17962-701.730(20), 180F.A.C., if the landfill will not have a constructed liner system.
191(3) Location requirements.
194(a) The site shall provide structural support for the facility including total wastes to be disposed of and structures to be built on the site.
219(b) A landfill or solid waste disposal unit shall not be located in the 100-year floodplain where it will restrict the flow of the 100-year flood, reduce the temporary water storage capacity of the floodplain unless compensating storage is provided, or result in a washout of solid waste.
267(c) The minimum horizontal separation between waste deposits in a landfill and the landfill property boundary shall be 100 feet, measured from the toe of the proposed final cover slope.
