62-730.160. Standards Applicable to Generators of Hazardous Waste

  • 1(1) The Department adopts by reference 740 CFR Part 262 11revised as of 14July 1, 2021 17http://www.flrules.org/Gateway/reference.asp?No=Ref-15288, 19and as amended in the 2486 Federal Register dated October 1, 2021 (54381-54386) 32http://www.flrules.org/Gateway/reference.asp?No=Ref-15292, 34including the Appendix, with the exception of 4140 CFR 262.16(c) 44and 262.10(k): 46and the optional addition of “267” to 53262.10(a)(2), 54262.10(f), 55262.10(g)(2), 262.11(e), 262.15(a), 262.16, 262.17, 60and 262.41(b)62.

    63(2) 64Large Quantity Generators, as defined in 7040 C.F.R Part 260.10 74shall submit biennial reports required by 8040 C.F.R. 262.41 83[as adopted in subsection 8762-730.160(1), 88F.A.C.] to the Department on Form 9462-730.900(8) 95(“96RCRA Subtitle C Site Identification and Hazardous Waste Report105”) as adopted in subsection 11062-730.150(3), 111F.A.C. Rule 11362-730.900, 114F.A.C., contains information on obtaining a copy of this form.

    124(3) Generators of hazardous waste who accumulate hazardous waste on-site under 13540 CFR 262.16, 138and 262.17 [as adopted in subsection 14462-730.160(1), 145F.A.C.], shall maintain written documentation of the inspections required under 15540 C.F.R 262.16 158and 262.17 [as adopted in subsection 16462-730.160(1), 165F.A.C.]166. The generator shall keep the written documentation of the inspections under this section for at least three years from the date of the inspection. At a minimum, this documentation shall include the date and time of the inspection, the legibly printed name of the inspector, the number of containers, the condition of the containers, a notation of the observations made, and the date and nature of any repairs or other remedial actions.

    239(4) Generators 241required to inspect containers under 24640 C.F.R. 262.16(b)(2)(iv) 249and 262.17(a)(1)(v), [as adopted in subsection 25562-730.160(1), 256F.A.C.] 257shall maintain adequate aisle space between containers of hazardous waste to allow for inspection of the condition and labels of the individual containers.

    280(5) 28140 C.F.R. 262.14(a)(5)(iii) 284[as adopted in subsection 28862-730.160(1), 289F.A.C.] shall refer to hazardous waste management programs approved by EPA.
