64B16-27.530. Duty of Pharmacist to Inform Regarding Drug Substitution

  • 1Prior to the delivery of the prescription, 8a pharmacist 10must 11inform the person presenting a prescription of any substitution of a generic drug product for a brand name drug product, of any retail price difference between the two, and of the person’s right to refuse the substitution. 48T49his information must be communicated at a meaningful time such as to allow 62the person 64to make an informed choice as to whether to exercise 74the 75option to refuse substitution without undue inconvenience to 83the presenter of the prescription 88or to the consumer of the drug. This information shall be communicated to the person presenting the prescription in a manner determined to be appropriate by the pharmacist using professional discretion and judgment.
