64B20-7.007. Mediation

  • 1(1) “Mediation” means a process whereby a mediator appointed by the Department acts to encourage and to facilitate resolution of a legally sufficient complaint. It is an informal and nonadversarial process with the objective of assisting the parties to reach a mutually acceptable agreement.

    45(2) The Board finds that mediation is an acceptable method of dispute resolution for the following violations:

    62(a) Failure of the licensee to timely respond to a continuing education audit;

    75(b) Failure of the licensee to pay a refund for a cancelled prescription hearing aid transaction in violation of Section 95468.1246 96or 97468.1255, F.S., 99unless the violation involves intentional misconduct by the licensee. A prescription hearing aid is defined in Rule 64B20-8.0011, F.A.C.
