1(1) Subject to the limitations imposed by this rule, the following violations are designated as minor for the purposes of Section 22456.073(3), F.S.
24(a) Violations of Section 28456.072(1)(r), F.S., 30improperly interfering with an investigation or inspection authorized by statute, or with any disciplinary proceeding;
45(b) Violations of Section 49456.072(1)(u), F.S., 51failing to comply with the requirements of Sections 59381.026 60and 61381.0261, F.S., 63to provide patients with information about their patient rights and how to file a patient complaint.
79(2) This designation of violations as minor for the purposes of Section 91456.073(3), F.S., 93is limited to initial violations.
98(3) A monthly report of notices of noncompliance issued by the Department shall be reviewed by the Board to monitor the use and success of this procedure.
