64E-28.009. Standards of Practice for a Tattoo Artist or Guest Tattoo Artist

  • 1(1) A tattoo artist shall ensure that a 9c10ustomer re12c13ord is 15c16ompleted for ea19c20h 21c22ustomer. The re25c26ord shall, at a minimum, in32c33lude the following:

    36(a) Name of tattoo artist.

    41(b) Customer’s name, age, and birthdate.

    47(c) Des49c50ription and lo53c54ation of tattoo on the 59c60ustomer’s body.

    62(d) Signature of the 66c67ustomer.

    68(e) Signature of the artist.

    73(f) Date(s) tattooing procedure is performed.

    79(2) Pursuant to Section 83381.00787, F.S., 85a tattoo artist shall not tattoo the body of a minor less than sixteen (16) years of age.

    103(3) If tattooing a minor who is sixteen (16) or seventeen (17) years of age, a tattoo artist shall:

    122(a) Inspect copies of a government-issued photo identification for both the minor and for the parent or legal guardian of the minor. If the photo identifi148c149ation for the minor does not show a birth date, a 160c161opy of the minor’s birth certificate shall be provided.

    170(b) Obtain a signed and notarized 176c177onsent by the minor’s parent or legal guardian on form DH 4146 , 7/12, Written Notarized Consent For Tattooing of a Minor Child, Age 16 through 17 Years Old, which is incorporated herein by reference and which can be obtained from the environmental health section of the county health department, which has jurisdiction for the tattooing program in the county where the tattoo artist lives or the tattoo establishment is physically located, or from the internet at 253https://www.flrules.org/Gateway/reference.asp?No=Ref-01528 255or 256http://www.myfloridaeh.com/community/Tattoo/index.html257.

    258(c) Complete the requirements of subsection (1).

    265(4) Prior to or after performing a tattoo pro274c275edure on a 278c279ustomer, a tattoo artist shall provide information on after288c289are to the 292c293ustomer, both verbally and in writing.

    299(5) Prior to setup for a tattoo pro307c308edure, a tattoo artist shall:

    313(a) Ensure that the skin area where a tattoo is to be applied is visibly healthy.

    329(b) Wash their hands thoroughly using liquid soap, rinse them, and dry them using single-use paper towels.

    346(6) Prior to performing a tattoo pro353c354edure, a tattoo artist shall 359c360leanse the area of the skin where the tattoo will be pla372c373ed using a using a 378c379lean, single-use paper towel or pad and a solution labeled as an antisepti392c393. The antisepti396c 397solution shall be used in a403c404c405ordan406c407e with the manufa411c412turer’s instru414c415tions.

    416(7) If hair is to be removed from the area to be tattooed, either a single-use razor shall be used, or 437c438lippers whi440c441h are 443c444apable of being disinfected. If hair removal is done after 454c455leansing, the area shall be re-461c462leansed as specified in subsection (6) above.

    469(8) While performing a tattoo pro475c476edure, a tattoo artist shall:

    481(a) Use asepti484c 485techniques, including barrier covers on instruments and equipment that may come into contact with the tattoo artist or the customer during the tattoo procedure. Should an artist choose to not use a barrier cover on the tattoo machine, they must disinfect the machine upon completion of the tattoo procedure.

    534(b) Use only sterile needle bars, sterile needle tubes, and single-use, sterile needles.

    547(548c549) Wear new, disposable examination gloves, whi556c557h shall be dis561c562arded after the 565c566ompletion of ea569c570h single tattooing session.

    5741. Should the gloves be579c580ome torn, pun583c584tured, or otherwise 587c588ontaminated outside the general s593c594ope of tattooing, or should the gloves 601c602ome in 604c605onta606c607t with any obje611c612t or surfa615c616e other than the 620c621ustomer’s skin or items being used in the pro630c631edure, the gloves shall be removed and dis639c640arded and the tattoo artist shall thoroughly wash their hands or apply an al654c655ohol-based hand sanitizer and re-glove before resuming the tattoo session.

    6652. In the event a tattoo artist must leave the tattooing area, the gloves shall be removed and dis684c685arded. The artist shall thoroughly wash their hands or apply an al697c698ohol-based hand sanitizer and re-glove before resuming the tattoo session.

    708(d) Dis710c711ard any sterile, single-use items that be718c719ome 720c721ontaminated and repla724c725e them with sterile items before resuming the pro734c735edure.

    736(e) Use a sten740c741il that is single-use and 746c747lean. The produ750c751t used to apply the sten757c758il shall be pa762c763kaged as a single dose or dispensed from a produ773c774t 775c776ontainer as a single 780c781ustomer dose.

    783(f) Any item used for freehand artistry on the customer shall be single-use and discarded after use unless an antiseptic is applied to the skin after marking the skin.

    812(g) Use inks, dyes, and pigments whi819c820h are intended for tattooing.

    8251. Inks shall be used in a832c833c834ordan835c836e with the manufa840c841turer’s instru843c844tions.

    8452. Individual portions of inks, dyes, or pigments shall be dispensed into 857c858lean single-use 860c861ups for ea864c865h customer.

    867(9) Any item whi871c872h an artist adds to a tattoo ma880c881hine to stabilize the needle shall be either single-use or a reusable item that has been disinfected.

    898(10) Upon 900c901ompletion of a tattooing pro906c907edure, a tattoo artist shall:

    912(a) Remove any ex916c917ess ink from the 921c922ustomer’s skin with a single-use 927c928lean paper towel or pad.

    933(b) Use a clean glove, single-use paper towel, or single-use pad to apply a moisturizing ointment or lotion that is pa954c955kaged as a single dose or is dispensed from a produ966c967t 968c969ontainer as a single customer dose.

    975(976c977) If needed, cover the tattooed area with a 986c987lean nonstick bandage.

    990(d) Remove and dis994c995ard any barriers used to 1000c1001over instruments and equipment and disinfe1007c1008t both the tattoo ma1013c1014hine and the work area with a tuber1022c1023ulo1024c1025idal disinfe1027c1028tant registered with the USEPA.

    1033(e) Remove any reusable instruments from the tattooing area in preparation for 1045c1046leaning, rinsing, drying, and sterilization.

    1051(f) Dis1053c1054ard any unused ink, dye, or pigment.

    1061(g) Thoroughly wash and rinse hands and dry them with 1071c1072lean single-use paper towels.
