64E-5.1501. Purpose and Scope

  • 1(1) The packaging and transportation of radioactive material are also subject to the requirements of other agencies such as the U.S. Department of Transportation, the U.S. Nuclear Regulatory Commission and the U.S. Postal Service. The requirements of this part are in addition to, and not in substitution for, other requirements.

    95(3) The regulations in this part apply to any licensee authorized by specific or general license issued by the department to receive, possess, use, or transfer licensed material, if the licensee delivers that material to a carrier for transport, transports the material outside the site of usage as specified in the license, or transports that material on public highways. No provision of this part authorizes possession of licensed material.

    164(4) Definition of terms used in this part are those listed in Rule 17764E-5.1502, 178F.A.C., as described in 18249 C.F.R. and 18510 C.F.R. 71.4, 188except that whenever a definition refers to evaluation or approval by the U.S. Department of Transportation or NRC, and such evaluation or approval is within the jurisdiction of the State of Florida as an Agreement State, the Department shall perform the evaluation or approval.
