1(1) A request for an amendment to a birth certificate made pursuant to subsection (1), of Section 18382.016, F.S., 20shall be submitted with an Application for Amendment to Florida Birth Record, DH Form 429 (04/16), hereby incorporated by reference and available from 43the Office of Vital Statistics at www.FloridaVitalStatisticsOnline.com, from 51http://www.flrules.org/Gateway/reference.asp?N53o54=Ref-07174, 55or from 57the Florida Department of Health, State Office of Vital Statistics, P.O. Box 210, Jacksonville, Florida 32231-0042, and accompanied by statutory fees required pursuant to subsection (3), of Rule 8564V-1.014, 86F.A.C., an Affidavit of Amendment to Certificate of Live Birth, DH Form 430 (04/16), hereby incorporated by reference and available from 107http://www.flrules.org/Gateway/reference.asp?No=Ref-07175, 109or from the Office of Vital Statistics at www.FloridaVitalStatisticsOnline.com, or from 120the Florida Department of Health, State Office of Vital Statistics, P.O. Box 210, Jacksonville, Florida 32231-0042, and documentary evidence, if required, by Rule 14364V-1.003, 144F.A.C. The required Affidavit of Amendment to Certificate of Live Birth, DH Form 430 (04/16), must be signed before a notarizing official by a registrant who is at least 18 years of age or if disability of nonage has been removed and the registrant provides proof of such removal; or if under 18, by his or her parent(s) named on the certificate or guardian or agency having legal custody of the registrant. When requesting any correction to the name of the registrant, both parents must sign the affidavit if both parents are named on the birth record.
241(2) A request for an amendment to a birth certificate made pursuant to Sections 25568.07(4), 256382.015, 257and 258382.016(1)(b), 259742.16, F.S., 261requires statutory fees as prescribed in subsection (4), of Rule 27164V-1.014, 272F.A.C., however, the amendment of the birth certificate shall not be withheld if the required fee does not accompany the request. The department shall in these instances amend the birth certificate and shall so notify the attorney, parent, or registrant, if of legal age, of the fee required for processing the amendment which includes one certification of the amended certificate.
