68A-29. Rules Relating To The Taking Of Mammals |
68A-29.002. Regulations Relating to the Taking of Mammals
1(1) 2For mammals not listed in Chapter 68A-27, F.A.C., or not regulated under Chapter 68A-24, F.A.C., the following restrictions control the take as defined in Rule 2768A-1.004, 28F.A.C. of the mammals listed below:
34(a) None of the following species or their young, homes, dens or nests shall be taken, transported, stored, served, bought, sold or possessed in any manner at any time except as authorized in the 68Commission’s Species Conservation Measures and Permitting Guidelines in subsection (b) 78or by permit from the executive director as provided in Rule 8968A-9.002, 9068A-9.006, 91or 9268A-9.010, 93F.A.C., relating to the permitting of take of wildlife or freshwater fish for justifiable purposes, wildlife rehabilitation, or take of nuisance wildlife:

279(2) 280No person shall buy, sell, or posess for sale any of the following mammals, except as authorized by chapter 68A-9, F.A.C., nor shall any person possess more than one of Eastern chipmunk (313Tamias striatus315), Southeastern pocket gopher (320Geomys pinetis322), or Marsh rabbit (327Sylvilagus palustris329). No person shall buy, sell, or possess for sale, except as authorized by chapter 68A-9, F.A.C., nor shall any person possess more than 3 Southern flying squirrels (358Glaucomys volans360) for personal use.
