68B-42.004. Size Limits

  • 1(1) 2The regulations in this section apply in all state waters and, in absence of any regulations for the species in federal waters, apply in adjacent federal Exclusive Economic Zone (EEZ) waters.

    33(2) Angelfishes:

    35(a) No person shall harvest, possess, or land any of the following species of angelfish 50(Family Pomacanthidae), of total length outside of the limits specified below61:

    621. A minimum of one-and-one-half (1 1/2) inches and a maximum of eight (8) inches for any species (including hybrids) of the Genus 85Pomacanthus86.

    872. A minimum of one-and-three-quarters (1 3/4) inches and a maximum of eight (8) inches for species (including hybrids) of the Genus 109Holacanthus, 110except for the species rock beauty (117Holacanthus tricolor119).

    1203. A minimum of two (2) inches and a maximum of five (5) inches for rock beauty (138Holacanthus tricolor140).

    141(b) Except as provided herein, no person shall purchase, sell, or exchange any angelfish outside the limits specified in paragraph (a). This prohibition shall not apply to angelfish legally harvested outside of state waters or federal Exclusive Economic Zone (EEZ) waters adjacent to state waters, which angelfish are entering 190Florida 191in interstate or international commerce. The burden shall be upon any person possessing such angelfish for sale or exchange to establish the chain of possession from the initial transaction after harvest, by appropriate receipt(s), bill(s) of sale, or bill(s) of lading, and any customs receipts, and to show that such angelfish originated from a point outside the waters of the State of Florida or federal Exclusive Economic Zone (EEZ) waters adjacent to Florida waters and entered the state in interstate or international commerce. Failure to maintain such documentation or to promptly produce same at the request of any duly authorized law enforcement officer shall constitute a violation of this rule.

    301(3) Butterflyfishes – No person shall harvest, possess, or land any butterflyfish (Family Chaetodontidae) of total length less than one (1) inch or greater than 4 inches.

    328(4) Gobies – No person shall harvest, possess, or land any gobie (Family Gobiidae) of total length greater than 2 inches.

    349(5) Jawfishes – No person shall harvest, possess, or land any jawfish (Family Opistognathidae) of total length greater than 4 inches.

    370(6) Porkfish – No person shall harvest, possess, or land any porkfish (383Anisotremus virginicus385) of total length less than 1 1/2 inches.

    394(7) Cuban (Spotfin) and Spanish hogfish:

    400(a) No person shall harvest, possess, or land any Spanish hogfish 411(Bodianus rufus) 413of total length less than 2 inches.

    420(b) No person shall harvest, possess, or land any Cuban (spotfin) hogfish (433Bodianus pulchellus435) of total length less than 3 inches.

    443(c) No person shall harvest, possess, or land any Spanish hogfish (455Bodianus rufus457) or Cuban (spotfin) hogfish (463Bodianus pulchellus465) of total length greater than 8 inches.

    473(8) Tangs – No person shall harvest, possess, or land any tangs (Family Acanthuridae) of fork length greater than 9 inches.

    494(9) Parrotfish – No person shall harvest, possess, or land any parrotfish (Family Scaridae) of total length greater than 12 inches.
