69B-250. Mediators |
1(1) An a4pplicant for approval to participate as a mediator in the property insurance claim mediation program pursuant to Section 22627.7015, F.S., 24or the motor vehicle insurance claim mediation program pursuant to section 35627.745, F.S., 37must submit a completed Form DFS-H2-591, 43http://www.flrules.org/Gateway/reference.asp?No=Ref-08550, 45Mediator Application, rev. 03/17, to the Department of Financial Services, Bureau of Licensing, 200 E. Gaines Street, Tallahassee, FL 32399-0319. The Mediator Application (Rev. 03/17) is hereby incorporated by reference, and 76can be obtained at the following website: http://www.myfloridacfo.com/Division/Agents/Licensure/Forms/documents/DFS-H2-591.pdf.
84(2) An applicant for approval as a mediator must meet one of the following requirements:
99(a) Possess an active certification as a Florida Supreme Court certified circuit court mediator, or
114(b) Was approved as a Department mediator as of July 1, 2014, and conducted at least one mediation on behalf of the Department during the period of June 30, 2010, through July 1, 2014.
148(3) The Department shall deny an application if the applicant fails to meet one of the qualifications in subsection (2), above.
169(4) A mediator shall incur a 6-month suspension of approval to participate in the property insurance claim and motor vehicle insurance claim mediation programs for failure to maintain his or her certification as a Florida Supreme Court certified circuit court mediator. Mediators qualifying based on their status as a Florida Supreme Court certified circuit court mediator must notify the Department in writing within 5 business days if such certification is placed in a lapsed, suspended, sanctioned, or decertified status. Such notice shall be mailed to the Bureau of Licensing at the address in subsection (1), or electronically submitted to the Department at AgentLicensing@MyFloridaCFO.com. A Florida Supreme Court certified circuit court mediator in a lapsed, suspended, sanctioned, or decertified status is not eligible to participate in either of the mediation programs until the certification is reinstated by the Florida Supreme Court.
309(5) The Department shall maintain a list of all approved mediators, which will include the mediator’s name, address, telephone number, a listing of counties in which each mediator is willing to mediate, and the date the mediator’s name was added to the list.
