69B-251.020. Penalties for Violations of Section 627.7074, F.S.


Effective on Thursday, September 14, 2017
  • 1(1) An application for certification as a neutral evaluator shall be denied by the Department if any of the grounds set forth in subparagraphs 25627.7074(7)(b)1. 26through 5., F.S., exist.

    30(2) If a certified neutral evaluator has violated the following provisions of section 43627.7074, F.S45., the following stated penalty shall apply:

    52(a) Failure to voluntarily withdraw from an evaluation due to the existence of any of the grounds set forth in paragraph 73627.7074(7)(a), F.S. 75– revocation.

    77(b) Subparagraph 79627.7074(7)(b)1., F.S.81:

    821. Suspension of 12 months if, had the application been accurate, the application would have been granted, based on the statutes and Department rules applicable to the application at the time the Department issued the certification and the documentation in the applicant’s file at the time the Department issued the certification, or

    1342. Revocation if, had the application been accurate, the application would have been denied, based on the statutes and Department rules applicable to the application at the time the Department issued the certification.

    173(d) Subparagraph 175627.7074(7)(b)3., F.S. 177– suspension of 12 months.

    182(e) Subparagraph 184627.7074(7)(b)4., F.S. 186– revocation.

    188(f) Subparagraph 190627.7074(7)(b)5., F.S. 192– revocation.

    194(g) Failure to adhere to the requirements of paragraph 203627.7074(7)(d), F.S. 205– suspension of 6 months.

    210(h) Failure to submit the report as required in subsection 220627.7074(12), F.S. 222– suspension of 6 months.
