69K-6.0054. Written Contracts Required


Effective on Wednesday, May 27, 1998
  • 1(1) Written contracts on all sales must be made between the cemetery company or preneed license and the purchaser which contracts shall state the sales prices, terms and other pertinent information relative to the transaction. Such contracts shall be serially numbered and filed by the cemetery company or preneed license in numerical sequence. All sales shall be entered into a sales journal numerically.

    64(2) Any additional purchases or deletions made by a customer more than 30 days subsequent to the original sale must be shown on a separate contract and shall be assigned a separate serial number which number shall be the current unused number in consecutive order.

    109(3) Only one preneed license and one seller shall be represented on a sales contract. A separate sales contract shall be written for each additional preneed license or seller represented on a contract.

    142(4) The Sales contract form must comply with all disclosure requirements of Chapter 497, F.S.

    157(5) A copy of the sales contract form must be approved by the Board of Funeral, Cemetery, and Consumer Services prior to use by the preneed license.
