69L-3.009. Injuries that Qualify as Grievous Bodily Harm of a Nature that Shocks the Conscience

  • 1For purposes of determining the compensability of employment-related posttraumtic stress disorder for first responders and correctional officers, the following injuries qualify as grievous bodily harm of a nature that shocks the conscience:

    33(1) Decapitation (full or partial),

    38(2) Degloving,

    40(3) Enucleation,

    42(4) Evisceration,

    44(5) Exposure of one or more of the following internal organs:

    55(a) Brain,

    57(b) Heart,

    59(c) Intestines,

    61(d) Kidneys,

    63(e) Liver, or

    66(f) Lungs

    68(6) Impalement,

    70(7) Severance (full or partial), and

    76(8) Third degree burn on 9% or more of the body.
