1This rule is adopted to implement the requirements of Section 111009.41, F.S., 13to establish criteria for documentation of a postsecondary student’s disability, as defined by the Americans with Disabilities Act, for financial aid eligibility as a part-time student.
39(1) The professional who prepares documentation must have expertise in the area related to the disability in question and be a licensed physician; a licensed psychologist; a licensed school psychologist; a certified school psychologist; a licensed audiologist; a licensed speech-language pathologist; or, a certified school speech-language pathologist.
86(2) The documentation must be sufficiently recent, as determined by the educational institution, and include a valid and reasonable assessment of the student’s needs; be specific and conclusive, demonstrating that the student has physical, emotional or mental impairment(s) which substantially limit(s) one or more major life activities, as well as showing how the disability will substantially limit the student’s ability to meet the minimum full-time load requirements.
153(3) The educational institution shall notify the Office of Student Financial Assistance with each term’s disbursement report of any student with disabilities for whom the part-time status is a necessary accommodation.
