73B-1.016. Reporting WIA, WT, WtW, and Wagner-Peyser Discrimination Complaints

  • 1(1) WIA Section 420 CFR 667.275(a) 7requires that recipients of WIA funds comply with federal nondiscrimination and other applicable equal opportunity laws. (See WIA Section 188 and 2829 CFR part 37.32)

    33(2) Guidance, found at 3720 CFR 645.255, 40provides that participants in Welfare-to-Work programs have the same rights that apply to any federal, state or local law that prohibits discrimination. Guidance, found at 6520 CFR 652.8(j), 68prohibits discrimination against applicants for or recipients of Wagner-Peyser program services.

    79(3) Under Wagner-Peyser, discrimination complaints may be filed directly with a local-office equal opportunity representative, when such has been designated and trained, with the state agency having administrative responsibility for Wagner-Peyser programs, or with the Civil Rights Center, U.S. Department of Labor.     126(4) As provided by Section 131760.06, 132Florida Statutes, employees or applicants may also choose to file employment complaints with the Florida Commission on Human Relations.
