  • 1(1) “Administrative Expenses” means those expenditures incurred for developing and administering the program. Expenditure of funds shall be subject to OMB Circular No. A-102, “Uniform Administrative Requirements for State and Local Governments” or OMB Circular No. A-110, “Grants and Agreements with Institutions of Higher Education, Hospitals, and Other Nonprofit Organizations,” and either OMB Circular No. A-87, “Cost Principles for State and Local Governments”, OMB Circular No. A-21, “Cost Principles for Educational Institutions,” or OMB Circular No. A-122, “Cost Principles for Nonprofit Organizations.”

    85(2) “Cash Match” means donated dollars including cash donations from individuals or corporations, private foundation grants, or general revenue dollars.

    105(3) “Department” means the Department of Community Affairs.

    113(4) “Elderly Person” means a person who is 60 years of age or older.

    127(5) “Emergency Repairs” means home repairs or improvements that are required, and if not made, could impair the health and safety of the occupants, or lead to serious structural damage to the dwelling unit, which could impair the health and safety of the inhabitants. Criteria for successful completion of the work shall be set forth in a grant agreement between the department and the grantee.

    192(6) “Dwelling Unit” or “Unit” means a house, including a stationary mobile home, an apartment, a group of rooms, or a single room occupied as separate living quarters.

    220(7) “F.A.W.” means Florida Administrative Weekly.

    226(8) “F.A.W. Notice” or “Notice” means a public announcement of funding availability published in the Florida Administrative Weekly.

    244(9) “Good Standing” shall mean satisfactory performance under prior weatherization and/or FloridaFix contracts and submission of all report documents as prescribed by past and present department contracts or legally binding agreements, as well as submission and resolution of all required monitoring findings, close-outs and audits to include payment of funds due the department as a result of these audits and close-outs.

    305(10) “Grantee” means a local public or private non-profit agency currently receiving funds from the department to conduct a Weatherization Assistance Program in one or more counties, or a public or non-profit agency chosen as outlined in Section 343420.36(4)(c)4., F.S.

    345(11) “Local Government” means any city, county, town, village, or other general purpose political body within the state.

    363(12) “Low Income” means that income in relation to that person's family size that is at, or below, 125 percent (125%) of the poverty level as specified annually in the U.S. Office of Management and Budget Poverty Guidelines, and in Rule 4049B-57.012, 405F.A.C.

    406(13) “Non-Cash Donations” means contributions other than cash including, but not limited to, contributed material, space or services; loaned vehicles, tools or equipment; discounts, advertising, consulting services and volunteer labor.

    436(14) “Non-Profit Corporation” means a corporation incorporated pursuant to Chapter 617, F.S.

    448(15) “Physically Disabled” means any individual who:

    455(a) Is determined to have a physical, mental or emotional impairment which:

    4671. Is expected to be of long-continued and indefinite duration,

    4772. Substantially impedes his or her ability to live independently, and

    4883. Is of such a nature that such ability could be improved by more suitable housing conditions; or

    506(b) Has a disability as defined in Section 223 of the Social Security Act; or

    521(c) Has a developmental disability as defined in section 102 of the Developmental Disabilities Assistance and Bill of Rights Act. Such term shall not exclude persons who have the disease of acquired immunodeficiency syndrome or any conditions arising from the etiologic agent for acquired immunodeficiency syndrome.

    567(16) “Subgrantee” means a local public or private non-profit agency experienced in weatherization, emergency repairs or rehabilitation of housing selected by the grantee, if the grantee is unable to serve all of the county or the target population. Eligibility of a subgrantee shall be determined by the department.

    615(17) “Termination” means the cancellation of funding, in whole or in part, under a subgrant at any time prior to its date of completion.

    639(18) “Weatherization Assistance Program” or “WAP”, means a state program administered by the department under Rule Chapter 9B-24, F.A.C.
