9J-35. Local Government Comprehensive Planning Certification Program |
1(1) Following the selection of applications described above, the Division shall certify all or part of each selected local government through a written agreement containing the components specified in Section 31163.3246(5), F.S.
33(2) If an applicant selected for certification in Rule 429J-35.006, 43F.A.C., chooses not to become certified or is disqualified through a challenge filed under Section 58120.569, F.S., 60or the Division and a selected applicant fail to reach an agreement, the Division shall offer the next eligible applicant, as determined pursuant to subsection 859J-35.006(2), 86F.A.C., the opportunity to become certified through a written agreement.
96(3) Local government applications that meet eligibility criteria but are not included in the first eight for which agreements are executed in a fiscal year will be given highest priority, in the order received, for certification in the subsequent fiscal year. Local governments wishing to retain such priority shall, during the application period described in Rule 1529J-35.003, 153F.A.C, submit the following to the Plan Review and Processing Administrator pursuant to Rule 1679J-35.004, 168F.A.C.:
169(a) A letter of intent to renew the application, which is submitted on the applicant’s letterhead and signed by the chief elected official or designee;
194(b) Documentation of the public hearing on the renewal of the application held pursuant to Section 210163.3246(2)(d), F.S.; 212and
213(c) Three (3) complete sets of materials that provide the information needed to update the application to reflect any changes within the jurisdiction, including amendments to the local government comprehensive plan or implementing regulations that were adopted subsequent to the submittal of the original application.
258(d) Updated comment letters regarding the appropriateness of the proposed certification from the state and regional review agencies.
