    PURPOSE AND EFFECT: The purpose and effect of the proposed rule is to amend the licensure requirements for home inspection course instructors.

    SUMMARY: The proposed rule would qualify additional instructors to teach home inspection prelicensure and continuing education courses.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS: The agency has determined that this rule will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule.

    A SERC has not been prepared by the agency.

    The agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: the economic review conducted by the agency.

    Any person who wishes to provide information regarding the statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    61-30.503 Course Approval, Prelicensure and Continuing Education.

    (1) through (8) No change.

    (9) Instructors must meet at least one of the following requirements:

    (a) All instructors must Hhold an active or inactive licenses as a home inspectors; and

    (b) Hold an active or inactive license in at least one of the eight components of a home inspection; or

    (c) Have at least three years of experience in the area in which they are instructing.

    (10)(b) Providers may not use instructors who are currently suspended or revoked due to disciplinary action against their license.
