    NOTICE IS HEREBY GIVEN that the Board of Pharmacy has received the petition for declaratory statement from Susan Trujillo, on behalf of PharMerica and AscriveRx America LLC, filed on January 8, 2019.The petition seeks the agency's opinion as to the applicability of Rule 64B16-28.607(2)(a), F.A.C., and Section 465.0235, F.S., as it applies to the petitioner.

    Petitioner seeks a Declaratory Statement from the Board seeking clarification on whether “automated pharmacy systems” may be placed in Assisted Living Facilities (ALFs). Except for good cause shown, motions for leave to intervene must be filed within 21 days after the publication of this notice.
