    NOTICE IS HEREBY GIVEN that Division of Drugs, Devices and Cosmetics has received the petition for declaratory statement from Daniel Hernandez, Attorney on behalf of Planned Parenthood of Southwest and Central Florida, Inc. and Planned Parenthood of South, East & North Florida, Inc. (Petitioners), on December 30, 2015. The petition seeks the agencys opinion as to the applicability of Sections 499.003(16), 499.003(54) and 499.01, Florida Statutes, and Rule 61N-1.012, Florida Administrative Code, as it applies to the petitioner.

    The Petition seeks a formal opinion from the Department as to whether the Petitioners are authorized, without the necessity of obtaining additional licensure or permitting from the division, to distribute prescription drugs amongst and between Petitioners’ various health care clinics where the clinics are under common ownership and control in light of the provisions of the federal Food, Drug and Cosmetic Act, as amended.
