The Board of Accountancy hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, filed on September 14, 2018, by David Keith Brown. The Notice of Petition for Waiver or Variance was published in Vol. 44, No. 194 of the September 14, 2018, Florida Administrative Register. Petitioner sought a waiver or variance of Rule 61H1-31.004, F.A.C., entitled, “Delinquency Fee,” which requires that a delinquent status licensee shall pay a delinquency fee of $25.00 when the licensee applies for active or inactive status. Petitioner also sought a variance or waiver of Rule 61H1-31.006, F.A.C., entitled “Reactivation Fee,” which requires that the application fee for reactivation of a delinquent status license to active is $250.00. The Board considered the instant Petition at a duly-noticed public meeting, held November 9, 2018, in Tampa, Florida.

The Board’s Order, filed on December 13, 2018, denied the petition, finding that Petitioner failed to establish that the purpose of the underlying statutes, would be met by granting a variance from Rules 61H1-31.004 and 61H1-31.006, F.A.C. The Board further found that Petitioner failed to establish that applying the requirements of the aforementioned rule to his circumstances would violate principles of fairness and impose substantial hardship.
