The Division denies the Petition for Declaratory Statement because pursuant to Section 120.565, Florida Statutes, Rule 28-105.003, Florida Administrative Code, a declaratory statement is not the proper forum to resolve disputes of fact. In addition, the Division may not issue a declaratory statement where the record does not contain competent substantial evidence.
