The Board of Medicine hereby gives notice that on January 12, 2016, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver or Variance was filed by Clifford P. Clark, III, M.D., on September 16, 2015, seeking a waiver or variance from Rule 64B8-9.009, F.A.C., with regard to the limitation on the amount of supernatant fat that can be removed during liposuction procedures in office surgery settings. The Notice was published in Volume 41, No. 205, of the Florida Administrative Register, on October 21, 2015. The Board, at its meetings held on December 4, 2015, voted to deny the Petition for Waiver finding that the Petitioner failed to cite to any administrative rule in his petition and appeared to seek a waiver from a statutory provision. The Board is precluded from waiving or granting variances to statutory provisions.
