The Board of Medicine hereby gives notice that on January 12, 2016, an Order was filed on the Petition for Waiver or Variance. The Petition for Waiver or Variance was filed on behalf of Bruce Hal Berman, M.D., on October 30, 2015, seeking a waiver from Rule 64B8- 8.0012., F.A.C., with regard to the requirement that Petitioner’s monitoring physician during the probationary period be a licensee under Chapter 458, F.S. The Notice was published in Volume 41, No. 213, of the Florida Administrative Register, on November 2, 2015. The Board, at its meeting held on December 4, 2015, voted to grant the Petition for Waiver or Variance finding that the Petitioner demonstrated a substantial hardship; that application of the rule would violate the principles of fairness; and that the purpose of the underlying statute has been met.
