    NOTICE IS HEREBY GIVEN that that the Florida Department of Environmental Protection, in its role as staff to the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida, has declined to rule on the petition for declaratory statement filed by Roy C. Johnson on September 10, 2019, and subsequently amended on October 2, 2019. The following is a summary of the agency's declination of the petition:

    A Final Order Denying Petition for Declaratory Statement was issued on December 19, 2019. The petition did not seek clarification of how statutes or rules apply to the petitioner's own circumstances or to the circumstances of a similarly situated entity, in order that the petitioner may select a proper course of action. Instead the petition sought a declaration that statutes and rules precluded a construction project that has already been completed. Thus the petition was denied.
