    PURPOSE AND EFFECT: The purpose of the proposed rule amendment is to reference new rule language relating to possession limits for deer harvested in Florida. The effect of the proposed rule amendment would be to exempt processors, storage facilities, and taxidermists from possession limits for harvested deer and cross-reference this rule with other existing rules providing exemptions to possession limits for harvested deer.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The nature of the rule and the preliminary analysis conducted to determine whether a SERC was required

    68A-13.001 Open Season for Taking Game; Bag and Possession Limits.

    (1) through (2) No change.

    (3) No person shall in any one day take more game than the daily bag limit or possess more than the maximum number of game birds or game animals allowed by the regulations of the Commission, except as provided by subsection (6) of this rule or Rule 68A-12.004 or 68A-13.004, F.A.C.

    (4) through (6) No change.
