Notice is hereby given that the Board of Medicine has received a Petition for Declaratory Statement filed on behalf of Alan Miller, M.D., on December 21, 2010. The Petitioner seeks the Board’s interpretation with regard to Section 456.053, F.S.

Specifically, the Petitioner requests guidance as to whether a “lease” arrangement in which a clinical laboratory pays a fixed monthly rental amount to “lease” a small space in the physician’s office and pays the physician an independent contractor fee for receptionist services so that the clinical laboratory can place its specimen collector in the physician’s office to perform specimen collections on the physician lessor’s patients would subject the Petitioner to discipline or other sanctions. The Board will consider this petition at its meeting scheduled for February 4, 2011.
