NOTICE IS HEREBY GIVEN that the Public Employees Relations Commission has declined to rule on the petition for declaratory statement filed by William Richardson on November 07, 2013. The following is a summary of the agency's declination of the petition:

The Commission declined to issue a declaratory statement finding that the petition did not comply with Section 120.565(2), Florida Statutes (2013), and Florida Administrative Rule 28-105.002. The petition sought a determination of the propriety of another individual’s conduct making a declaratory statement inappropriate. Additionally, the petition indicated that there was an existing conflict. Therefore, the questions raised by the petition should be addressed in an unfair labor practice case filed with the Commission. The Final Order denying the petition was issued January 8, 2014, in the case In Re Petition for Declaratory Statement of William Richardson, Case Number DS-2013-002.

A copy of the Order Declining of the Petition for Declaratory Statement may be obtained by contacting: Barry E. Dunn, Clerk, Public Employees Relations Commission, 4050 Esplanade Way, Suite 135, Tallahassee, Florida 32399-0950, (850)488-8641.
