The Board of Orthotists and Prosthetists hereby gives notice of issuance of an Order regarding the Petition for Variance or Waiver, filed August 27, 2014, by Robert N. Brown. Notice of Petition for Waiver or Variance was published October 24, 2014, in Vol. 40, No. 208, of the Florida Administrative Register. Petitioner requested a variance or waiver of the requirement in 64B14-4.001 and 4.003, F.A.C., that Petitioner submit a log confirming 1900 hours of orthotic experience and accept the two-part ABC examination in place at the time Petitioner was originally certified. The Board considered the Petition at a duly-noticed public meeting held October 17, 2014, in Kissimmee, Florida.
The Board’s Order, filed November 13, 2014, granted the Petition finding that the Petitioner has demonstrated he meets the purpose of the underlying statute by other means, has demonstrated a substantial hardship, and has demonstrated that application of the rules at issue would violate principles of fairness as defined by Section 120.542, F.S. and Chapter 28-104, F.A.C.
