    NOTICE IS HEREBY GIVEN that Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida has issued an order disposing of the petition for declaratory statement filed by Dave Jaye, Larry Mayer, Dr. Tom Breyer, Linda Berkman, and Peter C. Salamoun on January 13, 2020. The following is a summary of the agency’s disposition of the petition:

    The twenty-slip boat dock is a common element because it is a portion of the condominium property not included in the units; the Division cannot issue a declaratory statement regarding the conduct of another; and the Division cannot properly issue a declaratory statement regarding conduct which has already occurred.
