    NOTICE IS HEREBY GIVEN THAT the Division of Florida Land Sales, Condominiums, and Mobile Homes, Department of Business and Professional Regulation, State of Florida has received the petition for declaratory statement from Rick and Christine H. Irizarry, Unit Owners, In RE: Laguna Pointe Condominium Association of Pensacola, Inc., Docket No. 2008000543. The petition seeks the agency’s opinion as to the applicability of Chapter 718, F.S., and Rule 61B-23.002, F.A.C., as it applies to the petitioner.

    Whether tape recordings of board meetings made on the Secretary’s personal recorder are official records of the association once the minutes have been reduced to writing and approved by the board at a later meeting under Section 718.111(12), Florida Statutes, and subparagraph 61B-23.002(7)(b)3., Florida Administrative Code.
