The Board of Clinical Laboratory Personnel hereby gives notice: an Order was filed on the Petition for Variance and Waiver submitted by Nulvis Machado. The Petition for Variance and Waiver was filed on September 27, 2018, seeking a variance and waiver from Rule 64B3-5.003, F.A.C., which sets forth the education, training/experience and examination requirements for a specialty licensure as a medical technologist. The Notice was published in Volume 44, No. 211 of the Florida Administrative Register, on October 29, 2018. The Board, at its meeting held on December 7, 2018, in Howie in the Hills, Florida, voted to deny the Petition for Variance and Waiver finding that the Petitioner did not meet the purpose of the underlying statute by other means and that the application of the rule to Petitioner did not create a substantial hardship or violate the principles of fairness.
