NOTICE IS HEREBY GIVEN that the Department of Health has received the petition for declaratory statement from Opis Management Resources, LLC., on October 06, 2014. The petition seeks the agency’s opinion as to the applicability of paragraph 64E-16.003(2)(a), Florida Administrative Code, as it applies to the petitioner.

The Petitioner is asking for a declaratory statement from the Department in order to determine the extent of their duty to train personnel who handle biomedical waste within their facility. Specifically, Petitioner is requesting an interpretation of the term “personnel” as it applies to visiting physicians and other individuals who are not employees of Petitioner.
