    NOTICE IS HEREBY GIVEN that the Board of Physical Therapy Practice has received the petition for declaratory statement from Karen Luna, PT22027. The petition seeks the agencys opinion as to the applicability of 64B17-6.007 as it applies to the petitioner.

    Petitioner seeks a declaratory statement regarding the use of unlicensed personnel in connection with 64B17-6.007 Delegation to Unlicensed Personnel by the Physical Therapist. Specifically, the Petitioner asks for clarification whether a hospital is in compliance with the Board of Physical Therapy Practice act by implementing a walking program consisting of rehabilitation aides that are under the supervision of nursing but not a physical therapist, as they are not providing skilled physical therapy services, said patients not having been previously evaluated or screened by a physical therapist at the hospital. Except for good cause shown, motions for leave to intervene must be filed within 21 days after publication of this notice.
