    65G-2.0041License Violations - Disciplinary Actions

    PURPOSE AND EFFECT: The purpose and effect of the rule amendments is to designate additional Class 1 violations for facilities licensed by the Agency for Persons with Disabilities (“Agency”) under chapter 393, F.S. These are intended to promote compliance with the Agency’s licensing rules and deter staff of facilities licensed under chapter 393, F.S. from concealing license violations; hindering investigations relating to the health, safety, and welfare of residents and employees in Agency-licensed facilities; and permitting controlling entities who have been convicted of a disqualifying offense under chapter 435, F.S. from having contact with Agency clients.

    SUBJECT AREA TO BE ADDRESSED: The subject area to be addressed in the rule amendments is licensee action for which the Agency may pursue disciplinary action.
