    68A-26.002Regulations Relating to the Taking of Amphibians

    PURPOSE AND EFFECT: The purpose of the proposed rule amendment is to allow for the air gun as a method of take for certain frogs, specifically those not listed in rule chapter 68A-27, F.A.C. or otherwise restricted. The effect of the proposed rule amendment will be the allowance of an additional method of take for certain frogs.

    SUMMARY: The proposed rule amendment would allow the use of air guns for taking certain frogs, specifically those not listed in chapter 68A-27, or otherwise restricted.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The nature of the rule and the preliminary analysis conducted to determine whether a SERC was required.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    68A-26.002 Regulations Relating to the Taking of Amphibians.

    For amphibians not listed in Chapter 68A-27, F.A.C., the following restrictions control the take or possession:

    (1) No change.

    (2) Other frogs may be taken by gigs, clubs, blow guns, hook and line, air guns, firearms or manually. Frogs may be taken throughout the year including non-daylight hours except that they may only be taken by firearm during daylight hours.

    (3) through (4) No change.
