    FINAL ORDER

    APPROVING POLK COUNTY ORDINANCE NO. 17-066

    The Department of Economic Opportunity (“Department”) hereby issues its Final Order, pursuant to section 380.05(6), Florida Statutes, approving land development regulations adopted by Polk County, Florida, (the “County”) Ordinance No. 17-066 (the “Ordinance”).

    FINDINGS OF FACT

    1. The Green Swamp Area is designated by section 380.0551, Florida Statutes, as an area of critical state concern. The County is a local government within the Green Swamp Area of Critical State Concern.

    2. The Ordinance was adopted by the County on November 21, 2017, and rendered to the Department on November 27, 2017.

    3. The Ordinance amends the County’s Land Development Code text to establish Outdoor Concert Venue as a conditional use requiring Level 3 Review (C3), revise Section 303, Criteria for Conditional Uses, to specify criteria for Outdoor Concert Venues, adds definitions for “Outdoor Concert Venues” and “Outdoor Concerts” to Chapter 10, amends Section 207, Temporary Uses, to clarify that outdoor concerts of at least 500 persons are not to be permitted as Special Events, and modifies the following tables to allow for the C3 permits:

    Section 205, Tables 2.1; Section 401.01, Table 4.1c; Section 401.03, Table 4.8; Section 401.04, Table 4.12; Section 401.05, Table 4.14; Section 401.06, Table 4.16; Section 401.07, Table 1; Section 401.08, Table 401.08.01; Section 402, Table 4.25; Section 403.01, Table 4.  

    CONCLUSIONS OF LAW

    4. The Department is required to approve or reject land development regulations that are adopted by any local government in an area of critical state concern.  See section 380.05(6), Florida Statutes.

    5. “Land development regulations” include local zoning, subdivision, building, and other regulations controlling the development of land.  Section 380.031(8), Florida Statutes. The regulations adopted by the Ordinance are land development regulations. 

    6. The Ordinance is consistent with the County’s Comprehensive Plan generally, as required by section 163.3177(1), Florida Statutes, and specifically Policies 2.101A-A3, 2.110-I1, 2.115-A1, 2.117-A1, 2.161-C4, and 2.131-PA4.

    7. All land development regulations enacted, amended, or rescinded within an area of critical state concern must also be consistent with the principles for guiding development for that area.   See section 380.05(6), Florida Statutes. The Principles for Guiding Development for the Green Swamp Area of Critical State Concern are set forth in rule 28-26.003(1), Florida Administrative Code. 

    8. The Ordinance is consistent with all the Principles for Guiding Development.

    WHEREFORE, IT IS ORDERED that the Department finds that Polk County Ordinance No. 17-066 is consistent with the County’s Comprehensive Plan and the Principles for Guiding Development for the Green Swamp Area of Critical State Concern and is hereby APPROVED.

    This Order becomes effective 21 days after publication in the Florida Administrative Register unless a petition is timely filed as described in the Notice of Administrative Rights below.
